If your property runs on a private well instead of town water, knowing whether you can build an ADU can be a bit confusing if you don't understand it. You're not just dealing with septic capacity and lot size. You are dealing with a cap on the water flow that the state ties directly to your well. Most homeowners on wells don't even know this rule exists until they are pretty far in the planning process, and by then, the math either works or, sadly, it just doesn't.
My name is Buz Artiano, and I started BuildX. Since then we've built dozens of ADUs all over Massachusetts, but most of our builds have been around the South Shore and Plymouth County areas. We handle all the design, permitting, and construction ourselves, so we've dealt with the well question a lot. On well-lot properties, the first thing we need to answer is whether it's possible or not.
It all comes down to one rule, one calculation, and one workaround. The rule is a state-mandated flow cap tied to your water source. The calculation is done based on the bedroom count, which will determine whether your lot has capacity. And the workaround is a deed restriction strategy that some families use when the numbers don't add up at first.
Quick Answer: Yes, you can build an ADU on a well in Massachusetts, but only if your lot can support the state's rule of 440 gallons per day per acre. On a one-acre lot with a three-bedroom house, a one-bedroom ADU will usually work. On a lot with four bedrooms already taking up that amount, the answer is no, unless you reduce the bedroom count in the main house through a deed restriction. Most well lots in Massachusetts are at least 40,000 square feet, which is basically an acre.

Can I Add an ADU If My Property Has a Private Well?
Yes, but the state has a strict cap on the amount of water flow for properties with private wells. Under Title V, the maximum allowed is 440 gallons per day per acre. An acre under Title V is defined as 40,000 square feet. Every bedroom on the property counts for 110 gallons per day.
That means a one-acre lot can support a maximum of four bedrooms total between the ADU and the main house together. A half-acre lot is capped at 220 gallons per day, which supports two bedrooms. If you have a three-bedroom house on a full acre, you can simply add a one-bedroom ADU. If your house already has four bedrooms, then you're already at your maximum allowed water use.
This is a yes or no thing. There is no variance process or waiver that overrides the 440-gallon-per-acre limit. So before you start spending money on design or permitting, you need the numbers confirmed by a civil engineer who can look into your lot's Title V status. The state's ADU requirements, including how by-right regulations work with Title V, are available at mass.gov.
How Does the 440 Gallons Per Day Per Acre Rule Work?
The 440-gallon rule applies to any property on a well or that is in a Zone II, which is the zone of influence for a city well. The Department of Environmental Protection uses these caps on water usage to protect groundwater quality by limiting the total wastewater that has to be absorbed back into the land.
The calculation is super simple. Each bedroom counts for 110 gallons per day of water flow under Title V. On a one-acre lot (40,000 square feet), the total allowed flow is 440 gallons per day, which is enough for four bedrooms. On a half-acre lot (20,000 square feet), you only get 220 gallons per day, which is only enough for two bedrooms.
The bedroom count includes every bedroom in the main house and the ADU. If your main house has three bedrooms using 330 gallons per day, then you still have 110 gallons per day leftover, which is enough for one ADU bedroom. If your main house has four bedrooms, there's no remaining capacity for an ADU, regardless of lot conditions or your septic system.
Properties in nitrogen-sensitive zones by lakes, ponds, or protected waterways have the same 440-gallon cap, but there can also be extra environmental requirements. If your lot is near a water body, the engineering gets more complicated, but the flow limit never changes.
What If My Lot Is Too Small or My Bedroom Count Is Too High?
When the math says you're already using your full amount of allowed water flow, there is only one legitimate workaround. You have to reduce the bedroom count in your main house through a deed restriction. And this isn't just a theory of ours, we've seen families do it successfully. The process involves removing a bedroom from the main house, recording the change with a deed restriction, and using that flow for the ADU.
Here's how it works. Say you have a three-bedroom house on a half-acre lot with a well. Your total allowed flow is 220 gallons per day, and your three bedrooms use all of it. To build a one-bedroom ADU, you would deed-restrict the main house from three bedrooms to two. That frees up 110 gallons per day, exactly enough for a one-bedroom ADU. You would also need to make internal modifications to the main house to demonstrate that it now functions as a two-bedroom home.
We always look into this situation before we quote, because the bedroom reconfiguration changes the entire project. A family that goes into this process expecting to keep three bedrooms in the main house and add one in the ADU is going to hit a wall on their half-acre lot. We would rather find that out in the first conversation than have a family spend money on design only to learn that the math does not support their plan of adding another bedroom to the property. The deed restriction is permanent and officially recorded, so you need to think it through completely before making changes to the deed. But for families where keeping a parent close is more important than a spare bedroom, it is a real path forward.
But you must remember that you still have to build a new Title V-compliant septic system for the ADU no matter what. The deed restriction gives you the extra flow you need, but the ADU's septic system must meet current code. That is true regardless of the condition of your existing system.
Does My Existing Septic System Affect Whether I Can Build?
Yes, and the condition of your existing system is what determines what is possible and how much it will cost. Title V classifies septic systems into three categories that tell you what your next step is.
A conforming system is one that meets current Title V standards. This is the best-case scenario. If your existing system is conforming, the engineering team can work with it, potentially expanding capacity or connecting the ADU to the existing infrastructure if you've got extra capacity in your current setup.
A non-conforming system is one that was designed before the 1995 Title V update and hasn't been upgraded. Systems designed before that date are automatically classified as non-conforming by the DEP, even if they still work just fine. Non-conforming systems include cesspools, privies, and systems that have never received a variance or local upgrade approval.
A non-functioning or failed system is the worst-case scenario. If your system has failed, you have to start from scratch. The entire system has to be replaced before an ADU can be added, and the replacement must meet current Title V standards for the combined flow of the house and the ADU.
In all three cases, adding an ADU to an existing property meets the DEP's definition of new construction, which means you have to increase the actual design flow of the system. In April 2025 the DEP clarified this for ADU projects statewide.
Is a Well-Lot ADU the Right Move for Every Family?
No, and we tell everybody that directly. The 440-gallon flow cap is a hard constraint that no amount of creative engineering can override. If your lot is undersized, your bedroom count is maxed out, and a deed restriction doesn't make sense for your family's living situation, an ADU may not even be possible on your property.
We also work with families where the septic solution adds so much cost to the project that they just can't afford it anymore. A non-conforming or failed system on a lot with a well can add $40,000 to $60,000 or more to the project before anything even gets built. That doesn't mean the project is impossible, but it means that a conversation about the increased budget needs to be had before anything moves forward.

What Should You Do Before Spending Money on Design?
The single most important step for any ADU project on a lot with a well is confirming your flow capacity before committing to design or permitting. Know your lot size, your current bedroom count, your septic system's condition, and whether a deed restriction makes sense for your family. Those four things determine whether an ADU is possible on your property, and they cost a lot less to evaluate than a set of architectural plans you may never be able to use.
