How Close Can Your ADU Be to Wetlands in Massachusetts?

There's wet ground at the back of your lot. It might just be a seasonal puddle that doesn't dry, a swamp full of cattails, or a section that your neighbor once said was conservation land. You read your town's zoning setbacks, measured all your property lines, and found what you thought was a place to build an ADU. But then someone mentioned the word wetlands and you began to question your plan.

Massachusetts allows one accessory dwelling unit by right in single family zoning areas, although municipal building code, health code, and dimensional requirements still apply to every project. This is the position that we have on wetlands. A wetland doesn't stop an ADU project but it moves it. What will stop the project is when the buffer line isn't found until after the design phase is paid for, because then your ADU project is planned for the wrong 30 feet of the yard. What number decides where your ADU goes isn't a zoning bylaw, and it won't be the same as someone in the next town over.
Quick Answer: State law requires a 100-foot buffer zone around certain types of wetlands and everything inside it is governed by your local Conservation Commission. Your town then determines a tighter no-touch line within that buffer zone and that will decide where your ADU can be built. On our South Shore projects we've done those no-touch distances were 50 feet in Scituate, 75 in Marshfield, 65 in Carver, and 50 in Kingston. Massachusetts has no fixed no-touch distance of its own so be sure to check your town's current figure with its Conservation Commission before you pay for design, because Title 5 septic setbacks apply on top of that.

Where Does the Wetland Line Actually Stop You?
Two separate entities control a wet lot, and homeowners almost always find the wrong one first. The first one, which is the Massachusetts Wetlands Protection Act, is governed by the state. This Act deals with the work that's done inside 100 feet of a wetland resource area and your local conservation commission will review each project case by case using those rules. You can read the state's summary of that jurisdiction at mass.gov.
The second thing is what can stop construction. Within that 100-foot buffer, towns have a tighter no-touch zone in their own wetlands bylaw, and inside the no-touch zone you aren't allowed to build. The no-touch distance is set town by town, not by the state. That's why two families just a mile apart, on lots that look identical will get two different answers about ADU construction.
So the question isn't if you can build near a wetland. It's where your town's line is and then where the septic code puts your leaching field in relation to that same wetland. Those two distances together tell you where you have to fit an ADU into.
The Wetland Edge Is a Surveyed Line You Can Locate
Bordering vegetated wetland is called BVW on plans and permits, and it's the state's name for the wet ground around a pond, stream, lake, or river: the marsh, swamp, bog, or wet meadow at the edge of the water. It's a legal boundary that's decided by soils, vegetation, and hydrology, not just by where the ground looks soft in the spring. Every buffer and setback distance that we're giving you is measured horizontally from the outermost boundary and that's why this boundary has to be determined before distances mean anything.
The edge is found by a wetland scientist who walks the line and sets up flags. Then a surveyor picks up the flags and puts them on a plan. That process is a negotiation. On a survey day you could spend hours arguing about whether one flag should be moved two feet this way or two feet that way, because moving a flag two feet means two feet off every setback that follows it.
Before any of that is paid for, you can find approximate answers working from a desk. A civil engineer can look at the state's mapping and tell you whether wetlands or floodplains are involved on the project at all. It isn't a precise number and it won't work for the hearing, but it will tell you in one day whether you need to worry about this or not.
Why Is Every Town's No-Touch Number Different?
The no-touch distances didn't come out of a study. They came out of town meeting votes, one town at a time, and they've been going up for 30 years. When we started, there wasn't a no-touch zone, then it was 10 feet, and then 15, 25 and finally 50. The state doesn't have one. Massachusetts lets the commission have jurisdiction over the 100-foot buffer and then requires a review of every case, measuring it by performance standards. The hard line inside the buffer is an invention of your town and each town has its own.
That's not a complaint about the boards but it is a warning about your planning. Because these numbers are local policy then you can't argue about them and they don't go with you from the town that you used to live in. The only number that controls your ADU project is the one the Conservation Commission is currently enforcing.
Here's what we have worked with on our recent South Shore projects. Use these as the starting point when you call the commission, not as the final decision, because wetlands bylaws get changed and the commission is the one who decides the number.

The difference between the towns is the whole point. A Marshfield lot loses 25 more feet off the back than the same lot in Scituate, and 25 feet can decide if a detached ADU will fit behind the house or doesn't fit at all.
Does the Buffer Apply to Your Septic System Too?
It does, and in our experience it's the septic system and not the ADU itself that makes the difference. Under Title 5, the state septic code, the soil absorption system, which is the leaching field, has to be at least 50 feet from a bordering vegetated wetland, and the septic tank at least 25 feet. Local boards may require more than that. The full setback information is at mass.gov.
Some towns go a lot farther than that. In Kingston, no part of the septic system can be inside the buffer zone at all: not the leaching field, not the tank, not the pipe. Part has to be more than 100 feet from the wetland, and it's measured from the point where the first inch of pipe comes from the foundation.
That's why we plan out the septic system before we lay out the ADU when there is a wetland involved, which is backwards from how most builders work and backwards from how most homeowners think of it. A leaching field has to have a certain area of undisturbed soil at a specific elevation, and it can't be pushed six feet like a building can. So we plan the wetland edge first, then the town's no-touch line, then the setback for the septic and the reserve area you have to have in case the system ever fails. Whatever's left is the space we design for. Doing the order backwards from this makes a beautiful drawing of a building without any place for its wastewater to go, and we've been given this drawing by families who already paid for it.
Part of the rule isn't logical and it's worth pointing out because it influences how you see the numbers. The leaching field distance makes sense: that's where treated wastewater goes into the ground. The tank and the pipe are a closed system. Holding them to the time line or to a longer one, is just a policy choice not a scientific finding. That doesn't make the rule optional. It makes it something to measure early.
The Buffer Takes a Band Across the Full Width of Your Lot
The design of the loss surprises people more than the size of it. A buffer isn't a circle that's drawn around a puddle in one corner. It goes horizontally from the edge of the property farthest away from the water so a wetland along the back of your property takes away a uniform strip across the entire rear of the lot. Then when you add a 75-foot no-touch band at the back, the zoning setbacks off your side and rear property lines, the necessary distance between the ADU and the main house, and the septic distances from that same wetland edge, and the area you can build get smaller in all directions.
This is how Plymouth County ended up with single pieces of land scattered through it: strips and back corners left behind because they supposedly didn't meet the setbacks, and nobody has been able to use them since. Those pieces aren't bad land. They are land whose usable middle got measured away.
On a wet lot, three measurements settle where and if you can build before anything else does:
- The wetland edge, marked by a wetland scientist and put on a plan by a surveyor
- Your town's no-touch distance, measured horizontally from that edge
- The Title 5 septic distances and the reserve area, measured from the same edge
Size, layout, number of bedrooms, and finishes all come after these three things. Families who check on them first keep their options. Families who leave it for last end up paying more. Twice.
When Is a Wetland Lot Not Worth Designing Around?
We build ADUs for a living, so you'd expect us to tell you that there's a solution for every property. But there isn't. When a wetland runs the full width of the back of a small lot, the town has a 75-foot no-touch line, and the septic has to leave the wetland with a reserve area, then there are properties where the area that's left to build on is too small to comply with code and no amount of design will fix it. On those lots the honest answer is to stop before you end up paying a design fee instead of later.
We also can't tell you what your Conservation Commission will decide. Commissions review work on a case by case basis and make a decision based on the performance standards in the regulations. That decision is theirs, not your builder's. What we can do is give you an accurate plan of where the lines are, so you can have a conversation with the commission based on facts instead of a hopeful sketch. Anyone who tells you they can negotiate your buffer down is trying to sell you something.
The reason we'd prefer to give you a difficult answer early is simple. A family who finds out in the first week that the back of the lot isn't available to build on, still has money and choices. A family who finds that out in month four has a folder of drawings and a decision they were already attached to.
How Do You Find Your Buffer Line Before You Spend Money?
This decision is smaller than it feels, and it's measurable. Before you have someone draw up a design, you need three numbers on one plan: where the wetland edge sits, what your town's no-touch distance is, and where Title 5 says you have to put your septic components off that wetland. If those three give you an option, you have a project that's worth designing. If not, you kept your design fee and your time.
None of that takes a hearing, a filing, or a fight. It just takes measuring first, in the order the regulations measure, which is the order almost nobody starts with.
