If you're on a septic system and you want to build an ADU, you're probably wondering the same thing as a lot of other South Shore and rural Massachusetts homeowners. They want to know if being on septic means they can't build the ADU. It's not just you, everybody who is looking at building an ADU asks us this question. We understand people being worried about this. You don't want to spend money on design only to find out the ground on your property can't support it.

My name is Buz Artiano, and I'm the founder and CEO of BuildX. We've built dozens of ADUs across Massachusetts, mostly around the South Shore and throughout Plymouth County. Septic is a conversation we have almost every day, because most of our clients are on private septic systems, not town sewer. We handle design, permitting, and construction under one roof, which means we deal with Board of Health requirements, Title V compliance, and septic engineering as part of our standard process on a daily basis. We've done this enough to know that septic is the first issue we deal with.

In this article we'll help you understand how your septic system affects your ability to build an ADU, what determines whether your lot can support one, and what you should do before spending any money on design. Septic is the biggest wild card in the entire ADU process, especially in suburban and rural areas of Massachusetts. But it's a variable that we know about and have dealt with on almost every project. Once you understand the rules, you can make a well informed decision for your property.

Quick Answer: Your septic system doesn't automatically disqualify you from building an ADU, but it is the biggest variable we have to deal with on properties that don't connect to town sewer. Whether you can build depends on your existing system's Title V compliance, your lot size, bedroom count, soil conditions, and your town's Board of Health requirements. In nitrogen-sensitive areas, you probably need 10,000 square feet of land per bedroom on a regular system. Some towns require that you install a separate septic system for the ADU regardless of the current system you have for the main house. The only way to know for certain is to pull your Board of Health records and, in most cases, have someone do a perc test.

Does Being on Septic Mean I Cannot Build an ADU?

No. Being on a septic system does not mean you cannot build an ADU. But it does mean that your ADU project has a very important step that will decide if the septic system can be easily done. Those that are connected to the city sewer can skip this step entirely. The septic system is what is usually the biggest unknown in the whole ADU building process, especially in the towns where we build most often.

The reality is that if your current septic system is working and meets the current Title V regulations (the Massachusetts state code that regulates septic systems, that was enacted in its current form in 1995), you have options. You might be able to connect the ADU into your current septic system with some changes, or you may need a completely new system. The answer depends on your specific lot, your soil, your groundwater, and what your local Board of Health requires you to have.

The important point is that whether or not a certain septic system will work in your situation can be decided before going ahead with it. It isn't a mystery you have to live with. It requires investigation, and that will cost money but the answer will be definite once you have done the work. And you will know for sure whether your lot can support an ADU before you make a commitment to the design or construction.

What Determines Whether Your Septic Can Handle an ADU?

Four changeable things will determine whether your septic system can support an ADU. If you understand these from the beginning it will save you from putting money into an ADU that may not work on your specific property.

Title V compliance status. Title V is the Massachusetts law that governs all septic systems in the state. This current version took effect in 1995. If your septic system was put in after 1995 and you did not get permission to deviate from the normal zoning rules when it was installed, most Boards of Health will allow you to tie an ADU into that existing system with some changes. If your system was installed pre-1995, the Board of Health usually won't let you add an ADU to it without bringing the whole thing into current compliance. That can mean you will need a full replacement.

Lot size and bedroom count. If you are using a well and septic, Massachusetts requires 10,000 square feet of land for each bedroom under a normally designed septic system. A 40,000-square-foot lot with a four-bedroom house would have no bedroom capacity left under normal rules. A 60,000-square-foot lot with a three-bedroom house would have three bedrooms of remaining capacity. This formula is the best and quickest way to evaluate where you are starting from.

Soil conditions and groundwater. Your soil's percolation rate (how fast water drains through the ground) will directly decide what the size and cost of your septic system will be. Sandy soils that drain fast are common from Kingston south and have small affordable leaching fields. But dense, clay-heavy soils result in slow percolation rates, and need larger systems which means higher costs. The depth of the ground water matters just as much. The bottom of your leaching field must sit at least five feet above the estimated seasonal high groundwater table. If your water table is high, then you don't have as many options and your costs will increase.

Board of Health requirements. Your local Board of Health has a lot of authority over septic approvals. Some towns will make you put in a mandatory separate septic system for the ADU even if the system you have now has enough remaining room for it. This is not the case everywhere, but we have run into it on many ADU builds. The local Board of Health is the authority that approves it and how they interpret Title V can be different from town to town.

What Is a Perc Test and Why Do I Need One Before Designing an ADU?

A perc test (short for percolation test) is the field test that determines how porous your soil is. It is the single most important thing when you are deciding how doable your septic is. It is the step that will take your septic system from an unknown to a known part of the project.

The process works like this: someone who is licensed to check the soil will dig test pits at least as deep at 10 feet using an excavator. They will then check soil profile layer by layer. The top layer is your loam and below that is usually soil that is a brown secondary layer. Then below that are deeper soil layers that vary significantly depending on where your property is located. The soil will be evaluated for density, composition, and how much water there is in it.

Then water will be poured into the test pit, and the evaluator will see how quickly it drains. If the perc rate is less than two minutes for each inch, you have fast-draining soil (the sandy conditions common from Kingston south), so your system can be a smaller design, and your costs will be lower. However, if the soil is dense or has a lot of clay in it, the water takes longer to drain, the system will need to be larger and so will cost more money to install.

We inspect the septic before we give a quote on an ADU project, because that one single variable can decide whether a detached ADU is affordable on a certain property. On the South Shore, soil conditions can change dramatically within the space of a few feet. We've had a test pit on one side of a lot that came back with fast-draining sand and a pit on the other run into dense clay at just five feet. That is why the testers will dig more than one test pit on the same property. The soil underneath the site where you want to build your ADU could be completely different from the soil that's under the leach field you have now. This is also why we suggest looking at Board of Health property records for those lots right next to yours when doing early due diligence. If neighbors have had recent Title V work done, those records can give you information on soil conditions and depth of groundwater for your own property before you spend money on testing.

What Septic Modifications Will My ADU Require?

The modifications depend on your existing system, your lot, and your Board of Health. Here are three ways you can do it.

Tie into the existing system with a second tank. If your current system is Title V compliant (post-1995, no variances) and your lot still has extra bedroom capacity, sometimes you can just connect the ADU to your existing leaching field by adding a second septic tank. For a detached ADU, you almost always have to add another tank. For an attached ADU, you need either a multi-compartment tank or two tanks in series. The smallest tank you can have according to Title V is 1,500 gallons, and the second compartment tank is usually 1,000 gallons. These are standard sizes that are always available and not very expensive. This would be your cheapest option, so we always look to see if we can do it this way first.

Expand the existing system. If your current system has a compliant tank but not enough leaching field capacity, you might have to add a leaching field area. You have to have plenty of lot space, decent soil conditions, and Board of Health approval. The cost is somewhere in the middle of a simple tank addition and a full system replacement.

Install a complete new system. If your system predates 1995, has a variance, or is non-conforming for any reason, adding an ADU almost always means that you have to replace the whole system to meet current code. A non-conforming system is one that was designed before the 1995 Title V rewrite and has not been upgraded since. If your system received a variance in the past (for example, a reduction in groundwater separation), you can't add bedroom capacity to a system like that. The variance locks it down. A full system replacement is the most expensive option, but it is the most common on older properties.

In nitrogen-sensitive areas, especially around Cape Cod and in towns that are by protected water sources or town wells, you might also have to install a nitrogen removal system. They're basically miniature wastewater treatment plants inside a single tank unit. They replace a regular septic tank and treat wastewater even more before it gets to the leaching field. They do add to the price, but they let you build on lots that would otherwise not be possible under conventional septic design.

How Much Does Septic Work Add to an ADU Project?

Septic is the biggest cost variable in an ADU project, and it's extremely difficult to estimate before you go on-site and evaluate the conditions. Here's some of the ballpark prices that we've seen over many projects.

Adding a second tank to an existing compliant system is the cheapest option. That work usually costs around $10,000 to $12,000 for the tank addition and connection.

It can get more complicated if you need a pump chamber, alternative leaching field, or nitrogen removal system. Then you could be looking at as much as $40,000 or more. When you're talking about an ADU project that runs $250,000 to $350,000, a $40,000 septic system is a huge chunk of that budget.

A full system replacement on a lot with difficult soil conditions or high groundwater can get even more expensive. It all depends on what the perc test says, what the Board of Health requires, and how much engineering you need.

This is exactly why we always evaluate septic before we quote any job. Most builders don't include septic in their estimates. We do, because we've seen too many families get surprised by that number after they have already committed emotionally and financially to a design.

When Might Septic Make an ADU Impractical?

We build ADUs, and we want every project to move forward. But being honest about whether a project is possible or not is much better than giving you false hope about your ADU. There are situations where septic issues just don't allow an ADU, and we feel that you need to know that before you invest your time and money.

If your lot doesn't have any extra bedroom capacity with your conventional septic and a nitrogen removal system isn't affordable, the numbers just might not work. If your existing system has a variance that can't be extended, having to replace the whole system might push the total project cost above what your family is comfortable with. If your soil conditions have very slow percolation rates and your water table is high, the septic system alone could end up being a much bigger part of the budget than you planned for.

We encourage families in these situations to do a complete evaluation of the septic before making a final decision on the project. The perc test and Board of Health records will give you some good information. Sometimes the answer is to go with an attached ADU instead of detached, which can reduce the septic requirements in some towns. Sometimes the property just can't support any extra bedroom under current conditions. Either way, you'll know before you spend a lot of money on design and construction.

What Steps Should I Take to Find Out If My Lot Qualifies?

The investigation process goes in a certain order and you can't skip steps. The total cost to do all the necessary research is nothing compared to what it would cost to discover a septic problem after construction was already underway.

Pull your Board of Health records. Contact your town's Board of Health and request a copy of your current septic system design. You need to know when the system was installed, what it was permitted for (how many bedrooms), and whether any variances were granted. This step is free or nearly free and it's where you need to start.

Calculate your bedroom capacity. Using your lot size and existing bedroom count, apply the 10,000-square-foot-per-bedroom formula to see if you have any extra septic capacity on your lot. Your town assessor's office or your property deed can tell you how big your lot is.

Engage a licensed soil evaluator. A soil evaluator will do an instrument survey of your property (establishing property lines, topography, and setbacks), dig test pits, and do the perc test. Then you'll have the soil and groundwater data you need to determine what kind of septic solution your lot has to have.

Get a septic system design. Based on the perc test results and your ADU plan, a septic engineer designs the system and submits it to the Board of Health for approval. At this point, you've got answers and numbers.

The total investigation process, from pulling records through septic design, typically takes several weeks and there are costs for the survey, perc test, and engineering. But at the end of it, you have your answer, no guessing. You'll know if your lot can support an ADU or if it can't under the current conditions, and you'll know how much the septic solution will cost. It's absolutely worth the money to know what you're up against.

Your Septic Is the First Question to Answer, Not the Last

The families who have the smoothest ADU projects are the ones who answer the septic question first. Before you fall in love with a floor plan, before you commit to a budget, and before you hire a builder, find out what the ground on your property can support. Septic is the wild card, but we can get clarification on it. The investigation process exists so that you can have definitive answers.
