Avon's ADU bylaw lives in § 255-5.8 of the Zoning Bylaw (Chapter 255), adopted under Article 12 of the May 6, 2025 Annual Town Meeting [Bylaw §255-5.8]. The bylaw text reads:
One Avon-specific local restriction. Section 255-5.8(I) explicitly prohibits use of an ADU as a short-term rental as defined in MGL c. 64G, § 1 [Bylaw §255-5.8]. Massachusetts state law allows local STR restrictions, so Avon's prohibition is enforceable. Long-term rental, in-law occupancy, and family use are all permitted. If your business model is Airbnb or VRBO, Avon is not your town.
No minimum lot size. Avon's bylaw subjects ADUs to the dimensional requirements of § 255-6.4 (§ 255-5.8(D)), and under state law (760 CMR 71.03(3)(b)) minimum lot size requirements are not applicable to a protected-use ADU [760 CMR 71]. Avon is small and densely built; this exemption means many narrow or small lots that would otherwise be too small for new construction can still host an ADU as long as setback, height, and bulk requirements are met.
Existing structures and nonconforming lots can be converted. Section 255-5.8(H) allows an existing structure, principal dwelling, or nonconforming lot to be used for or converted into a protected-use ADU, provided it is done in conformance with the Building Code, 760 CMR 71.00, and state law.

Where ADUs are NOT by-right
Avon's other zoning districts — General Business, Industrial, Commercial, Mixed Use-Low Density, and Residential High Density — do not permit single-family dwellings or protected-use ADUs by-right (the Table of Use Regulations, § 255-5.3, marks "Protected use ADU" as "N" in those districts). In Avon, the ADU is a single-family-district use.

EXCEPTION: if your lot is within 1/2 mile of a bus station, no additional parking is required. Avon's bylaw § 255-5.8G waives the ADU parking space within 1/2 mile of a bus station. Avon is served by Brockton Area Transit Authority (BAT) routes; whether a parcel qualifies depends on proximity to a bus station.
Did Avon recently update its flood maps?
Yes. At the May 6, 2025 Annual Town Meeting (Article 8), Avon amended its Floodplain Overlay District (§ 255-11.3) to adopt the updated Norfolk County FEMA Flood Insurance Rate Map, effective July 8, 2025 (Zones A and AE). If your property falls in a special flood hazard area under the current map, NFIP construction requirements (elevation, flood vents, engineer-stamped flood compliance) apply to your ADU project. Always verify your specific parcel against the effective FIRM before designing.
Do I need to live there?
Owner-occupancy is not required for protected-use ADUs under state law. Massachusetts 760 CMR 71.00 preempts local owner-occupancy mandates for ADUs that qualify as protected use. Avon's bylaw (§ 255-5.8) does not impose an owner-occupancy requirement. Confirm current administrative posture with the Avon Building Department at (508) 588-0414 ext. 1022 before signing a lease.
How long does an Avon ADU permit take?
Plan on 60 to 90 days for a clean by-right Avon ADU permit through Permit Eyes. Avon's single-step process (no separate zoning permit) is faster than two-step towns like Plymouth.
