ADU Rules in Middleborough, MA
Yes. Middleborough allows ADUs by-right up to 900 sq ft under Section 7.7. The friction is not zoning. It is septic and multi-watershed Title 5 review, the required deed restriction, the Middleborough Gas and Electric propane rule, and conservation filings near the Nemasket River.

Middleborough allows ADUs by-right
Section 7.7 Accessory Dwelling Units · published Planning Board Administrative RegulationsMiddleborough has fully implemented its local ADU bylaw, Section 7.7 Accessory Dwelling Units, and the Planning Board has published Administrative Regulations governing Site Plan Review specifically for ADUs [Section 7.7 Admin Regs]. The Administrative Regulations reference the final EOHLC regulations under 760 CMR 71.00 [760 CMR 71]. Protected-use ADUs up to 900 sq ft are allowed by-right with a building permit. No special permit is required. Site Plan Review under Section 7.7 is procedural, not a discretionary special permit.
Can I build an ADU in Middleborough, MA?
Yes. Middleborough allows attached and detached ADUs by-right under Section 7.7 in districts that allow single-family dwellings, up to 900 sq ft. A building permit and procedural Site Plan Review under Section 7.7 apply. No special permit is required. ADU and main house must stay in single ownership, with a deed restriction recorded at the Plymouth County Registry of Deeds.
Show full bylaw scope and state preemption note
Middleborough's ADU rules live in Section 7.7 Accessory Dwelling Units of the Zoning Bylaw, administered through the Section 9.0 Administration and Procedures framework [Section 9.0]. Section 7.7 is one of the more thoroughly implemented ADU bylaws we have reviewed in the region: the Planning Board has published a standalone Administrative Regulations document for ADU Site Plan Review, and that document references the final EOHLC regulations under 760 CMR 71.00 [Section 7.7 Admin Regs].
What "by-right" means here. For a protected-use ADU at or under 900 sq ft on a lot that allows a single-family dwelling, you do not need a special permit. You file for a building permit and go through procedural Site Plan Review under Section 7.7. The state floor under 760 CMR 71.00 (effective February 2, 2025), enacted through the Affordable Homes Act amendments to MGL Chapter 40A [MGL 40A], is one ADU per lot, up to 900 sq ft or 50% of the principal dwelling, whichever is smaller, by-right in zones that allow single-family dwellings. Middleborough's Section 7.7 aligns with that floor and adds the local provisions described below [Section 7.7 summary].
Middleborough has substantial agricultural zoning in its outlying portions, plus cranberry-bog and farmland areas. An ADU must be accessory to a single-family residence, not to an agricultural use. If your parcel is in an agricultural zone, confirm your residential ADU eligibility with the Middleborough Planning Department at (508) 946-2425 before design.
What you do need to plan for in Middleborough is the local layer on top of the state floor: a required deed restriction, a short-term-rental prohibition, the Middleborough Gas and Electric propane rule, and multi-watershed Title 5 review. Each is covered in its own section below.
Garage conversion ADU
A common variation of either the attached or detached ADU path, depending on the garage configuration. Section 7.7 does not treat a garage conversion as a separate ADU category; it is classified based on whether the converted structure is attached to the principal dwelling.
- If the garage is attached to the house: Treated as an attached ADU. Attached ADUs can share an entry hall but need a separate entry within the hall.
- If the garage is detached from the house: Treated as a detached ADU. Detached ADUs are allowed up to 2 stories or 25 feet, whichever is shorter.
- Best for: Properties with a structurally sound existing garage; ability to reuse foundation, walls, and roof; faster path than ground-up construction.
- Watch for: Foundation adequacy, insulation upgrades, separate-entrance and bathroom plumbing, replacement of the garage door with proper wall and window framing, and the MG&E gas or all-electric decision.

What Can Complicate a Middleborough ADU?
Middleborough is the second-largest municipality by land area in Massachusetts, roughly 70 square miles [Census]. Your parcel's septic, watershed, gas service, and ownership setup, not the bylaw, usually drive cost and timeline. The factors that come up most often:
Do I need septic approval for a Middleborough ADU? Septic
Likely affects you if: your parcel is in the outlying portions of town rather than central downtown. Middleborough has municipal sewer in the central downtown, and most outlying areas are on private septic.
Yes if your parcel is on private septic. Adding a bedroom adds wastewater design flow, so a Title 5 inspection and capacity check are typically required before the ADU permit is approved. Title 5 (310 CMR 15.000) and a reserve-area requirement apply on septic-served lots [Title 5].
Cost impact: $30,000 to $60,000 most likely for a Title 5 capacity check plus possible system replacement when an older system cannot carry an additional ADU bedroom.
Middleborough's three-watershed coverage matters here. The eastern portions toward Lakeville sit in the Assawompset Pond watershed, a New Bedford and Taunton drinking-water source, where Board of Health and Title 5 standards can be stricter. Confirm sewer availability and watershed status for your specific parcel before design.
Do watershed or conservation rules affect Middleborough ADUs? Watershed
Likely affects you if: your lot is near a wetland resource area, the Nemasket River corridor, a pond, a cranberry bog, or one of the three watersheds that cross Middleborough.
Middleborough sits at the junction of three watersheds: the Taunton River watershed in the western and southern portions, the Assawompset Pond and New Bedford watershed in the eastern portions toward Lakeville, and the Nemasket River, which runs through town and carries an anadromous fish run. Different watershed, different Title 5 and Board of Health expectations. We pull the watershed map for any specific property [MassGIS].
The Conservation Commission administers wetlands review under the Wetlands Protection Act, MGL c.131 §40 [Wetlands Act], plus the local wetlands posture. Adding an ADU near a wetland resource area or the Nemasket River triggers a filing.
Cost impact: +$5,000 to $15,000, plus 6 to 10 weeks of additional review when a project sits near a resource area.
Does Middleborough require a deed restriction for an ADU? Ownership
Yes. Section 7.7 requires the ADU and the main house to remain in single ownership, and a deed restriction recorded at the Plymouth County Registry of Deeds is required [Section 7.7 Admin Regs] [Plymouth Deeds]. This is the most explicit ownership control we have seen in the region.
Practically, this means you cannot sell the ADU separately from the main house. The two stay together on one deed. It adds a recording step at closing, but it provides certainty about what you are allowed to do with the unit.
We coordinate the deed restriction recording at the Plymouth County Registry of Deeds in Plymouth as part of the project, so it does not become a last-minute surprise at the permit or closing stage.
How does Middleborough Gas and Electric affect my ADU? Utilities
Middleborough has its own municipal gas and electric utility, Middleborough Gas and Electric (MG&E). Section 7.7 prohibits propane on lots that already have an MG&E gas connection. If gas service exists at your property, the ADU must use that gas service rather than propane [Section 7.7 Admin Regs].
BuildX designs all-electric. An all-electric ADU avoids the MG&E gas-versus-propane question entirely, because there is no fossil-fuel appliance to route. If you want gas appliances and your lot has MG&E service, we plan the build around the gas connection rather than propane.
Confirm your lot's MG&E gas connection status before design. The gas-or-electric decision affects appliance selection, venting, and the utility run.
What flood-zone rules affect Middleborough ADUs? Flood
Middleborough is an inland town, so it does not carry coastal flood exposure. It does have riverine flood zones. FEMA maps riverine Zone A along the Nemasket River and other water bodies [FEMA].
If your parcel is along the Nemasket River corridor or another mapped water body, an ADU there is a different project, with possible elevation and flood-resistant construction requirements. Verify your specific address against the FEMA flood map before design. We run this check on Day 1.
Does the MBTA station affect Middleborough ADU parking? Transit
Middleborough has an in-town commuter rail station, Middleborough Station on West Grove Street, which opened March 24, 2025 as part of South Coast Rail Phase 1. It replaced the former Middleborough/Lakeville station, which was renamed Lakeville station and sits in neighboring Lakeville, now serving only the seasonal CapeFLYER. The line was renamed the Fall River/New Bedford Line and runs through to New Bedford [MBTA].
Properties within 0.5 miles of the station may qualify for the state's transit-adjacent parking exemption under MBTA Communities provisions [760 CMR 71]. That can mean fewer required off-street parking spaces for an ADU. Verify your parcel's distance to the station for your specific address.
Combined with Middleborough's strategic location at the I-495 and I-195 junction, station-adjacent parcels see strong rental demand from commuters and the regional workforce.
What Does a Middleborough ADU Cost?
A Middleborough ADU should not be priced from square footage alone. Two 800 sq ft ADUs can price very differently depending on septic capacity, which watershed the lot drains to, conservation review, the deed-restriction recording, and site access.
That is the full span of our 14 floor plans. Prices include the complete building package, foundation through move-in-ready finishes. Site work is priced separately after a lot evaluation.
Middleborough-specific cost premium factors
See full ADU pricing and floor plans. For a Middleborough-specific quote, call (781) 627-7000. We will not quote a Middleborough ADU until we know your sewer or septic status, which watershed your parcel drains to, your MG&E gas connection status, and any wetland or flood proximity.
How the Middleborough ADU Permit Process Works
A building permit plus procedural Site Plan Review under Section 7.7. The Building Inspector is the permit-granting authority.
-
1
Parcel review
1 to 2 weeks
BuildX maps your parcel against zoning, sewer or septic, watershed, FEMA flood zone, wetlands, aquifer overlay, MG&E gas service, and historic resources status before quoting. This is the step that determines whether the rest of the timeline is straightforward or extended. MassGIS overlay checks happen on Day 1.
-
2
Building permit and Site Plan Review
Building Inspector final action within 30 days under Section 9.0
File for a building permit and the procedural Site Plan Review under Section 7.7. Applications are submitted through Middleborough's Online Permitting and picked up at the office [Online Permitting]. The Building Inspector is the permit-granting authority. For protected-use ADUs at or under 900 sq ft, no special permit is required.
-
3
Overlay and watershed reviews (if triggered)
Add 6 to 10 weeks when triggered
Title 5 septic review on septic-served parcels (MassDEP 310 CMR 15.000, with a reserve-area requirement), Conservation Commission filing for any wetland-adjacent or Nemasket River-adjacent work (MGL c.131 §40), and Board of Health coordination, which is stricter in the eastern Assawompset watershed portions. These can extend the critical path.
-
4
Deed restriction recording
At closing
Section 7.7 requires a deed restriction recorded at the Plymouth County Registry of Deeds keeping the ADU and main house in single ownership [Plymouth Deeds]. We coordinate this recording as part of the project.
Overall planning assumption: 90 to 120 days from contract signing to construction start for a clean, sewered or septic-clear parcel with no watershed or wetland triggers. Add 6 to 10 weeks for Title 5, conservation, or watershed reviews.
After permits issue, construction inspections run through the Middleborough Building Department. Inspection requests are taken from 8:00 to 9:30 AM, Monday to Friday, at (508) 946-2426. Plan ahead for that narrow window.
What Middleborough Zoning Districts Allow ADUs?
Middleborough uses a traditional use-separation zoning structure with substantial agricultural zoning in its outlying portions and a central downtown core. As the second-largest municipality by land area in Massachusetts (about 70 square miles), it has a wide mix of residential, agricultural, and rural land. An ADU must be accessory to a single-family residence. The dimensional schedule lives in Section 4.0 Dimensional Requirements. Exact lot, frontage, setback, and coverage values are best confirmed by parcel with the Planning Department.
Residential districts ADU by-right under Section 7.7
- ADU allowance: Attached and detached ADUs allowed by-right under Section 7.7 on lots that allow a single-family dwelling, up to 900 sq ft.
- Detached height: 2 stories or 25 feet, whichever is shorter (Section 7.7).
- Min lot, frontage, setbacks, coverage: Per the Section 4.0 Dimensional Requirements table. Confirm exact values with the Middleborough Planning Department [Bylaws and Reports].
What this means for your ADU: In a residential district, the path is a building permit plus procedural Site Plan Review under Section 7.7. The constraints that move feasibility are septic capacity, watershed, and the deed restriction, not the zoning allowance itself.
Agricultural and rural outlying areas Verify residential eligibility
Many outlying portions of Middleborough are zoned agricultural, including cranberry-bog and farmland areas associated with the A.D. Makepeace Company. An ADU must be accessory to a single-family residence, not to an agricultural use.
If your parcel is in an agricultural or rural zone, confirm with the Middleborough Planning Department at (508) 946-2425 whether the parcel is eligible for a residential ADU before you design. This is a parcel-level determination, not something to assume from the zoning map.
Central downtown Sewer
The central downtown around 20 Center Street is the sewered core, closer to municipal services and the municipal complex. Lower septic risk applies here. Some downtown parcels may fall near historic resources and could draw Historical Commission attention; the Historical Commission is referenced in the Section 9.0 review framework.
What this means for your ADU: Downtown parcels often avoid the septic and watershed cost drivers that dominate the outlying lots, which can simplify the budget.
Overlay considerations. Aquifer, watershed, wetlands.
Multiple aquifer and Zone II wellhead protection zones cross Middleborough, and the town has a substantial municipal water supply [MassGIS]. Overlay and watershed analysis happens on Day 1 with MassGIS layers. We pull your parcel's overlays before quoting.
Source: Middleborough Zoning Bylaw, Section 3.0 Use Regulations [Section 3.0 Use Reg]. The full Zoning Bylaw is published through the town's Bylaws and Reports page [Bylaws and Reports]. Section 7.7 Administrative Regulations are published by the Planning Board.
Sewer or Septic? Middleborough Is Mixed.
This is the single biggest cost variable in any Middleborough ADU project. Middleborough has municipal sewer in the central downtown, and most outlying areas are on private septic. Because the town spans three watersheds, the Title 5 and Board of Health expectations on a septic lot can vary by where the parcel drains.
Show Title 5, water utility, and watershed details
- Water utility: Middleborough has a substantial municipal water supply, with multiple aquifer and Zone II wellhead protection overlays [MassGIS]
- Gas and electric: Middleborough Gas and Electric (MG&E), a municipal utility. Propane is prohibited on MG&E gas-served lots per Section 7.7.
- Septic upgrade cost: $30,000 to $60,000 most likely
- Title 5 trigger: Adding a bedroom adds design flow, so Title 5 inspection and a reserve area are required on septic parcels [Title 5]
- Watersheds: Taunton River, Assawompset Pond, and Nemasket River. Different watershed, different Board of Health expectations.
Central downtown is sewered. Most outlying areas are on septic. We do not quote a Middleborough ADU until we know which side of that line your parcel sits on, and which watershed it drains to. A Title 5 inspection answers the septic question for your specific property.
Middleborough Is Many Markets in One
As one of the largest towns in the region by area, with a population of about 24,500 [Census Reporter], Middleborough has more distinct ADU contexts than most. Central downtown, the transit-adjacent station area, three watershed zones, agricultural and cranberry-bog land, and historic resources each carry their own ADU considerations. A downtown ADU is a different project from one on an outlying agricultural lot.
Middleborough ADU Feasibility by Area (At a Glance)
| Middleborough Area | Common ADU Issue | BuildX Note |
|---|---|---|
| Central Downtown | Sewered, possible historic resources, services close | Lower septic risk; watch for Historical Commission attention |
| Station area (within 0.5 mi) | Transit-adjacent, parking exemption may apply | Strong rental demand; verify the 0.5-mile distance by address |
| Eastern portions (toward Lakeville) | Septic, Assawompset Pond watershed | Stricter Title 5 and Board of Health expectations |
| Western and southern portions | Septic, Taunton River watershed | Title 5 capacity and watershed status drive cost |
| Nemasket River corridor | Conservation filings, possible riverine flood zone | Conservation Commission review; verify FEMA flood status |
| Agricultural and cranberry-bog areas | Agricultural zoning, residential eligibility | ADU must be accessory to a single-family residence; verify with Planning |
| Lots with an existing Middleborough Gas and Electric connection add the propane-prohibition rule. An all-electric design avoids it. See the MG&E card above. | ||

The Nemasket River runs through town and carries an anadromous fish run. Conservation filings and possible riverine flood zones apply along the corridor.
Septic risk: Septic plus conservation review.
Agricultural and Cranberry-Bog Areas Zoning
Working farmland and cranberry bogs in the outlying portions, including A.D. Makepeace Company land. Verify residential versus agricultural zoning; an ADU must be accessory to a single-family residence.
Septic risk: Septic, larger lots.
What Middleborough's Bylaw Says
Middleborough's own Section 7.7 and Section 9.0 set the operating posture in writing. The bylaw text is the authority.
This Bylaw shall be enforced by the Building Inspector or if there should be a void in said office, by the Board of Selectmen.
That is the operating posture of the Town of Middleborough. The Building Inspector is the permit-granting authority and takes final action on petitions for permits within 30 days. Section 9.0 also carries a 21-day rule for board and agency reviews: if a board or agency does not make recommendations within 21 days of receiving the petition, that silence is deemed a lack of opposition. For a protected-use ADU at or under 900 sq ft, you file for a building permit and the procedural Site Plan Review under Section 7.7. No special permit, no discretionary hearing.

Middleborough ADU FAQs
Can I build a detached ADU in Middleborough?
Yes, by-right. Middleborough has fully implemented Section 7.7 Accessory Dwelling Units, with published Planning Board Administrative Regulations governing Site Plan Review for ADUs. Attached and detached ADUs are allowed by-right on lots that allow a single-family dwelling, up to 900 sq ft. A detached ADU may be up to 2 stories or 25 feet, whichever is shorter.
Do I need a special permit for a Middleborough ADU?
No. For a protected-use ADU at or under 900 sq ft, you file for a building permit and the procedural Site Plan Review under Section 7.7. Site Plan Review is procedural, not a discretionary special permit. The Building Inspector is the permit-granting authority and takes final action on petitions for permits within 30 days under Section 9.0.
Do I need to live there?
State law (760 CMR 71.00, effective February 2, 2025) preempts owner-occupancy requirements for protected-use ADUs [ADU FAQs]. Confirm how Middleborough is administering Section 7.7 on this point with the Planning Department at (508) 946-2425 before signing a lease. Note that the ADU and main house must remain in single ownership, with a recorded deed restriction, which is a separate requirement from owner-occupancy.
Can I Airbnb my Middleborough ADU?
No. Section 7.7 explicitly prohibits short-term rental of an ADU in Middleborough. Long-term rentals are allowed. If your business model is Airbnb or VRBO, Middleborough is not your town for an ADU.
How big can a Middleborough ADU be?
Up to 900 square feet, or up to 50% of the principal home's gross floor area, whichever is smaller. This matches the state by-right floor under 760 CMR 71.00. A detached ADU may be up to 2 stories or 25 feet, whichever is shorter, which is more permissive than some towns in the region.
Can I sell the ADU separately?
No. Section 7.7 requires the ADU and the main house to remain in single ownership, and a deed restriction recorded at the Plymouth County Registry of Deeds enforces it. The two stay together on one deed. We coordinate that recording as part of the project.
What about Middleborough Gas and Electric?
Middleborough has its own municipal gas and electric utility, MG&E. Section 7.7 prohibits propane on lots that already have an MG&E gas connection. If gas service exists, the ADU must use gas rather than propane. BuildX designs all-electric, which avoids the question entirely. Confirm your lot's gas connection status before design.
Sewer or septic in Middleborough?
Depends on location. The central downtown is on municipal sewer. Most outlying areas are on private septic. This is the single biggest cost variable. A Title 5 capacity check plus possible system replacement adds $30,000 to $60,000 to a septic-served Middleborough ADU. Because the town spans three watersheds, the Board of Health expectations on a septic lot can vary by where the parcel drains, with stricter standards in the eastern Assawompset watershed portions.
What does a Middleborough ADU cost?
BuildX ADU pricing ranges from $284,301 to $525,861. That covers the complete building package, foundation through move-in-ready finishes; site work is priced separately after a lot evaluation. Middleborough-specific drivers move a project within that band: a septic upgrade adds $30,000 to $60,000, a Conservation Commission filing near a wetland or the Nemasket River adds $5,000 to $15,000 plus 6 to 10 weeks, and the deed-restriction recording adds a fee and a closing step. For a property-specific quote, call (781) 627-7000.
How long does a Middleborough ADU permit take?
Plan on 90 to 120 days from contract signing to construction start for a clean parcel with no watershed or wetland triggers. The Building Inspector takes final action on petitions for permits within 30 days under Section 9.0. Add 6 to 10 weeks for Title 5 septic review, Conservation Commission filings, or watershed coordination. Applications are submitted through Middleborough's Online Permitting and picked up at the office.
Who do I call about building an ADU in Middleborough?
For official town process questions (permits, fees, inspection scheduling, building code interpretation), call the Middleborough Building Department at (508) 946-2426. For Site Plan Review under Section 7.7, the Planning Department is at (508) 946-2425.
For parcel-level feasibility, cost estimates, design options, watershed and septic considerations, and construction planning, call BuildX at (781) 627-7000.
The two are different conversations. The town can tell you what is administratively required. BuildX can tell you what is realistic on your specific parcel and what it will actually cost to build.

Thinking about an ADU in Middleborough?
BuildX can review your Middleborough parcel for zoning, sewer or septic, watershed, FEMA flood zone, wetlands, aquifer overlay, MG&E gas service, and the required deed restriction before you spend money on design or permitting. Middleborough is BuildX home territory, at the center of the region we build in, so we know the constraints that drive your project and the path through Section 7.7.
