Kingston Town Meeting adopted Article 30 at the April 26, 2025 Annual Town Meeting [Article 30], amending Section 7.8 of the Zoning Bylaw to align local rules with the Massachusetts Affordable Homes Act [MGL 40A] and the state ADU regulations at 760 CMR 71.00 [760 CMR 71]. The Planning Board recommended adoption 5 to 0 and the Board of Selectmen recommended adoption 5 to 0. Kingston runs two distinct ADU paths: a Protected path that is by-right up to 900 sq ft or 50% of the principal dwelling, and an Unprotected path by Planning Board Special Permit for larger or otherwise nonconforming units.

Can I build an ADU in Kingston, MA?

Yes. Kingston allows a Protected ADU by-right in the R20, R40, R80, Town Center, and 3A Design District zones, up to 900 sq ft or 50% of the principal dwelling, whichever is smaller. Kingston's ADU rules live in Section 7.8 of the Zoning Bylaw (Residential Accessory Housing Units), with supporting definitions in Section 2.2 and the Table of Uses Footnote 4. The controlling vote was Article 30 of the April 26, 2025 Annual Town Meeting [Article 30]. The current effective Section 7.8 text reflects that amendment [§7.8 text].

The Protected path (by-right). A Protected ADU is permitted by-right with a Zoning Permit plus a Building Permit, no special permit and no public hearing, in the R20, R40, R80, Town Center (TC), and 3A Design District (3A DD) zones [§7.8.2.a]. A Protected ADU is capped at 900 sq ft or 50% of the principal dwelling gross floor area, whichever is smaller, matching the state by-right standard under 760 CMR 71.00 [760 CMR 71]. Owner-occupancy is not required for a Protected ADU. The one required parking space is waived if any part of the lot is within 0.5 mile of public transit, per the bylaw text, which explicitly references 760 CMR 71.00 [§7.8.2.a.ii]. Short-term rental is prohibited.

The Unprotected path (Special Permit). Anything larger than the Protected definition, or otherwise nonconforming, follows the Unprotected path. The Planning Board acts as the Special Permit Granting Authority [§7.8.2.b]. The Unprotected path carries its own review criteria under §7.8.3, including a minimum lot of 20,000 sq ft, a principal dwelling of at least 1,200 sq ft, a minimum ADU of 350 sq ft, a maximum ADU of 30% of the combined normally-habitable gross floor area, detached setbacks of 25 ft front, 20 ft rear, and 15 ft side, owner-occupancy with an annual January 31 recertification, a 45-day minimum rental term, a 25% lot-coverage cap, and recording at the Plymouth County Registry of Deeds [§7.8.3].

One conflict rule to know. Section 7.8.5.d states that where the ADU bylaw conflicts with other sections of the Zoning Bylaw, the most restrictive ADU provision applies to the permit [§7.8.5.d]. In practice, that means the stricter of two overlapping rules governs your project.

The Jones River runs through Kingston to Kingston Bay. It is not a federally designated Wild and Scenic river, but the Massachusetts Rivers Protection Act applies a 200-foot Riverfront Area along it [MA Rivers]. The Kingston Conservation Commission is very active given the combination of the Jones River, the Silver Lake watershed, Kingston Bay, cranberry bogs, and multiple wetland resource areas, all reviewed under the Wetlands Protection Act [WPA].

Adding an ADU near a wetland resource area or inside the Riverfront Area triggers a Conservation Commission filing. Plan on adding roughly 6 to 10 weeks to the timeline for projects near resource areas.

Part of Kingston sits over the regional Plymouth-Carver Aquifer, a major southeastern Massachusetts drinking-water resource shared with Plymouth and neighboring towns. Town Center (TC) Protected ADU by-right

ADU rules: Protected ADU allowed by-right up to 900 sq ft or 50% of the principal dwelling, whichever is smaller. For the Unprotected path, the Town Center is eligible only on lots whose primary use was residential as of May 11, 2024 [Article 30].

What this means for your ADU: The Town Center is denser and more walkable, with Kingston Station nearby, which can support the parking waiver for Protected ADUs. Confirm dimensional values and the May 11, 2024 use cutoff with the Planning Department.

3A Design District (3A DD) Protected ADU by-right

What Kingston's ADU Bylaw Says

Kingston's own Section 7.8 states the purpose of its ADU rules. The bylaw text is the authority on what the town intends.

"To enable homeowners who wish to remain in their homes and neighborhoods to do so. To promote more efficient use of the existing housing stock by allowing flexibility in response to changing household sizes. To promote a wider price range of rental housing and home ownership for small households." Kingston Zoning Bylaw §7.8.1 (Purpose), as adopted by Article 30 of the April 26, 2025 Annual Town Meeting [§7.8.1 Purpose].

That purpose runs through both pathways. A Protected ADU at or under 900 sq ft (or 50% of the principal dwelling) is by-right with a Zoning Permit and a Building Permit. A larger or nonconforming ADU follows the Unprotected path by Planning Board Special Permit. Where rules overlap, Section 7.8.5.d directs that the most restrictive ADU provision applies [§7.8.5.d]. Can I build a detached ADU in Kingston?

Yes. Kingston allows detached, attached, and interior-conversion ADUs on both pathways. A Protected ADU is by-right up to 900 sq ft or 50% of the principal dwelling in the R20, R40, R80, Town Center, and 3A Design District zones. A larger or nonconforming detached ADU follows the Unprotected path by Planning Board Special Permit.

What is the difference between a Protected and an Unprotected ADU in Kingston?

A Protected ADU meets the state by-right standard: up to 900 sq ft or 50% of the principal dwelling, whichever is smaller. It is permitted by-right with a Zoning Permit and a Building Permit, no special permit and no public hearing, and it does not require owner-occupancy. An Unprotected ADU is anything larger or otherwise nonconforming. It requires a Planning Board Special Permit, carries its own dimensional floors under §7.8.3, requires owner-occupancy with an annual January 31 recertification, and must be recorded at the Plymouth County Registry of Deeds.

Do I need a special permit for a Kingston ADU?

Not for a Protected ADU. A Protected ADU that meets the criteria goes through the by-right Zoning Permit and Building Permit sequence with no special permit and no public hearing . An Unprotected ADU, meaning one larger than the Protected definition or otherwise nonconforming, does require a Planning Board Special Permit. The Planning Board acts as the Special Permit Granting Authority.

How big can a Kingston ADU be?

A Protected ADU can be up to 900 square feet, or up to 50% of the principal home's gross floor area, whichever is smaller. That is the same cap as the state by-right protection under 760 CMR 71.00. If you want a larger ADU, you move to the Unprotected path, where the unit is capped at 30% of the combined normally-habitable gross floor area, with a minimum of 350 sq ft, on a lot of at least 20,000 sq ft with a principal dwelling of at least 1,200 sq ft.

Do I need to live there?

It depends on the pathway. A Protected ADU does not require owner-occupancy, which matches state law under 760 CMR 71.00, so a pure rental arrangement is possible. An Unprotected ADU does require owner-occupancy, with an annual recertification due January 31 under §7.8.5. Confirm the current administrative posture with the Kingston Building Department at (781) 585-0500 before signing a lease.

Can I Airbnb my Kingston ADU?

No. Section 7.8 prohibits using an ADU as a short-term rental as defined by MGL c. 64G on both pathways [MGL 64G]. The Unprotected path also sets a 45-day minimum rental term. State law allows local short-term-rental restrictions, so Kingston's prohibition is enforceable. Long-term rentals are fine.

Does the Silver Lake watershed affect my Kingston ADU?

If your parcel sits inside the Watershed Protection Overlay District, yes. Silver Lake is Brockton's primary drinking-water supply, and Kingston applies stricter septic standards, impervious-surface limits, and Conservation Commission plus MassDEP review inside the overlay. Adding an ADU bedroom adds wastewater design flow, which becomes the central Title 5 conversation on overlay parcels. A MassGIS overlay check on Day 1 confirms whether your parcel is inside the boundary.

Sewer or septic in Kingston?

Depends on the parcel. The Kingston Wastewater Department serves the Town Center and the commercial corridor. Most Kingston residential properties are on private septic. This is one of the biggest cost variables, and inside the Silver Lake watershed overlay the requirements are stricter. A Title 5 capacity check plus possible system replacement adds $30,000 to $60,000 to a septic-served Kingston ADU project.

What does a Kingston ADU cost?

How long does a Kingston ADU permit take?

A clean Protected ADU can move quickly through the by-right Zoning Permit and Building Permit sequence.
