Yes. Falmouth has a long-standing Accessory Apartment Bylaw and has been one of Cape Cod's most active ADU towns, with 21 ADU permits approved before the state law took effect (per the Housing Assistance Corporation of Cape Cod). Confirm whether the bylaw has been updated to align with state law (760 CMR 71.00) with the Falmouth Building Department before you design.

Do I need a special permit for a Falmouth ADU?

No, not for a protected-use ADU. Under state law (760 CMR 71.00, effective February 2, 2025), protected-use ADUs up to 900 sq ft are allowed by-right in zones that permit single-family dwellings, with special-permit and owner-occupancy requirements preempted. Falmouth has historically been by-right friendly on ADUs. Confirm the current process with the Building Department.

Will I need an I/A septic system in Falmouth?

Possibly, depending on your watershed status and your existing system. Many Falmouth properties are in Nitrogen Sensitive Areas, where I/A systems can be required.
