Sewer or Septic? Mashpee Is Mostly Septic.

Can I build a detached ADU in Mashpee?

Yes, by-right. Under Massachusetts state law (760 CMR 71.00, effective February 2, 2025), a protected-use ADU up to 900 sq ft is allowed by-right in zones that permit single-family dwellings, and that includes detached, attached, and interior-conversion ADUs. Do I need a special permit for a Mashpee ADU?

No, not for a protected-use ADU at or under 900 sq ft. State law makes it by-right, and Mashpee did not require a special permit for accessory apartments even before the state rules. Do I need to live there?

Will I need a Cape Cod nitrogen septic system?

Possibly, depending on your watershed and nitrogen status. Many Mashpee properties sit in Cape Cod nitrogen-sensitive areas, where state Title 5 and Mashpee's own Chapter 107 Nitrogen Control Bylaw apply. A Best Available Nitrogen Reducing Technology (I/A) septic system adds $30,000 to $50,000 or more when required.
