ADU Rules in Hanover, MA

Yes. Hanover allows ADUs, and state law protects them up to 900 sq ft by-right. The friction is not zoning. It is septic capacity (Hanover has no public sewer), aquifer and wellhead overlays near the Pond Street Wells, and Conservation Commission filings inside wetland buffers.

Hanover allows ADUs

Town Meeting adopted ADU amendments · May 7, 2024 ATM (AGO approved June 2024), refined at the May 5 to 6, 2025 ATM

Hanover Town Meeting first adopted Accessory Dwelling Unit amendments within the Residence A District (§6.000) of the Zoning Bylaw at the May 7, 2024 Annual Town Meeting, which the Attorney General approved in June 2024, then refined the ADU provisions at the May 5-6, 2025 Annual Town Meeting to raise the local size limit to 900 sq ft [Zoning Bylaw]. Under the local bylaw, an attached ADU is an allowed use with a building permit (§6.010.J), while a detached ADU needs a special permit with Site Plan Approval from the Planning Board (§6.040.B); both are capped at 900 sq ft and two bedrooms, and the bylaw requires the owner to occupy the principal dwelling or the ADU. Under Massachusetts state law, a protected-use ADU up to 900 sq ft in a single-family zone is permitted by-right, which overrides those local special-permit and owner-occupancy requirements for a protected-use ADU.

Allowed BuildX Hanover office Septic, no public sewer Long-term rental allowed

State law overrides the local special-permit and owner-occupancy rules. Massachusetts state ADU law (760 CMR 71.00, effective January 31, 2025) protects a protected-use ADU up to 900 sq ft by-right in single-family zones, with no special permit and no owner-occupancy requirement [760 CMR 71]. Hanover's local bylaw still requires a special permit with Site Plan Approval for a detached ADU (§6.040.B) and requires owner-occupancy for both attached and detached ADUs; per Attorney General guidance, those conflicting local provisions are unenforceable as applied to a protected-use ADU. In practice, a Hanover ADU at or under 900 sq ft on a single-family lot is a by-right protected-use ADU. Confirm how Hanover is administering protected-use ADUs versus its local special-permit and owner-occupancy language with the Building Commissioner at (781) 826-5000 ext. 1078 before you design.

Can I build an ADU in Hanover, MA?

Yes. Hanover adopted ADU amendments within the Residence A District (§6.000) of its Zoning Bylaw (May 2024, refined May 2025 to a 900 sq ft size limit). Locally, an attached ADU is an allowed use with a building permit (§6.010.J) and a detached ADU needs a special permit with Site Plan Approval (§6.040.B), each capped at 900 sq ft and two bedrooms, with an owner-occupancy requirement. Under state law (760 CMR 71.00), a protected-use ADU up to 900 sq ft in a single-family zone is by-right with no special permit and no owner-occupancy requirement, which overrides those conflicting local provisions for a protected-use ADU. Hanover has no public sewer, so every ADU is a Title 5 septic project.

Show the bylaw definition, citation, and state preemption note

Hanover's ADU rules live in the Residence A District (§6.000) of the Zoning Bylaw (attached ADU at §6.010.J, detached ADU at §6.040.B), with a supporting definition at §2.100 [Zoning Bylaw]. The attached-ADU definition reads:

"An attached Accessory Dwelling Unit is a self-contained housing unit incorporated within a single-family dwelling, (not within accessory structures in accordance with this By-law) that is clearly a subordinate part of the single-family dwelling and complies with the criteria stated in Section 6.010.J." Hanover Zoning Bylaw, definitions section (amended May 7, 2024; submitted to the Attorney General June 2024; further amended through the May 5 to 6, 2025 ATM).

One state preemption note. Hanover's local bylaw requires a special permit with Site Plan Approval for a detached ADU (§6.040.B, capped at 900 sq ft) and requires owner-occupancy for both attached and detached ADUs. Massachusetts state law (760 CMR 71.00, effective January 31, 2025) protects a protected-use ADU up to 900 sq ft by-right in zones that allow single-family dwellings, with no special permit and no owner-occupancy requirement [760 CMR 71]. Per Attorney General guidance, a local provision that conflicts with that protection is unenforceable. So a 900 sq ft or smaller ADU on a Hanover single-family lot should be a by-right project, not a special-permit or owner-occupancy case. How Hanover is administering its local special-permit and owner-occupancy language day to day is a question for the Building Commissioner, and we recommend confirming it before you submit.

Hanover's local bylaw requires the owner to occupy either the principal dwelling or the ADU (§6.010.J for attached, §6.040.B for detached, plus a recorded covenant). State law bars an owner-occupancy mandate for a protected-use ADU, so that local requirement is unenforceable as applied to a protected-use ADU up to 900 sq ft, and long-term rental is allowed. Hanover's bylaw does not address short-term rental specifically. Confirm both the owner-occupancy posture and any short-term-rental plan with the Building Commissioner before you count on them.

For most homeowners, the practical answer is straightforward. A Hanover ADU at or under 900 sq ft, on a single-family lot in a residential district, is protected by-right under state law. What moves the timeline and the budget is not the bylaw. It is septic, because Hanover has no public sewer for residential properties, plus any aquifer, wellhead, or wetland-buffer overlay your parcel sits in.

Garage conversion ADU

A common variation of either the detached or attached ADU path, depending on the garage configuration. Hanover's bylaw does not treat garage conversion as a separate ADU category; it is classified based on whether the converted structure is structurally attached to the principal dwelling.

  • If the garage is attached to the house: Treated as an attached ADU (regular building permit path)
  • If the garage is detached from the house: Treated as a detached ADU: a local special permit with Site Plan Approval, but by-right under the state 900 sq ft protected-use floor; confirm posture with the Building Commissioner
  • Best for: Properties with a structurally sound existing garage; ability to reuse foundation, walls, and roof; faster than ground-up construction
  • Watch for: Septic design flow if a bedroom is added, foundation adequacy, insulation upgrades, separate-entrance and bathroom plumbing, replacing the garage door with proper wall and window framing, and parking if original spaces are lost

What Can Complicate a Hanover ADU?

In Hanover, your parcel's septic capacity and overlays, not the bylaw, are usually what move project cost and timeline. The factors that come up most often:

Do I need septic approval for a Hanover ADU? Septic

Likely affects you: Hanover has no public sewer for residential properties, so this applies to essentially every Hanover ADU. Verify your specific parcel's system.

Yes. Hanover has no public sewer for residential properties, so every Hanover ADU is a Title 5 conversation. Adding an ADU bedroom adds wastewater design flow, so a Title 5 capacity check is typically required before the ADU permit is approved. An older three-bedroom septic system often will not carry an additional ADU bedroom without an upgrade.

Cost impact: $30,000 to $60,000 for a Title 5 capacity check plus possible system replacement when an older system cannot carry the additional ADU bedroom.

Hanover is a partner town in the North and South Rivers Watershed Association (NSRWA) WaterSmart South Shore SepticSmart program, alongside Cohasset, Duxbury, Hingham, Hull, Kingston, Marshfield, Norwell, Pembroke, Rockland, Scituate, and Weymouth. The Hanover Conservation Commission also administers local septic regulations that supplement state Title 5 and Board of Health rules.

How does Hanover's aquifer overlay affect ADUs? Aquifer

Likely affects you if: your parcel falls within a DEP-approved Zone II wellhead protection area or one of Hanover's water resource and aquifer protection districts. Verify your parcel by address.

Hanover relies on its own municipal well system, including the Pond Street Wells. Significant portions of town fall within DEP-approved Zone II wellhead protection areas [MassDEP SWAP]. Hanover's Zoning Bylaw includes a Floodplain, Wetland and Watershed Protection District, a Water Resource District, and Aquifer and Well Protection Districts.

Near the Pond Street Wells, ADU septic siting is reviewed more carefully. Adding a bedroom adds wastewater design flow, and Zone II overlays limit how septic systems can be sited and sized, which can trigger heightened review. A MassGIS overlay check on Day 1 tells you whether your parcel sits within a Zone II wellhead protection area or an aquifer protection district. We pull this before quoting.

Do wetlands or conservation rules affect Hanover ADUs? Wetlands

Likely affects you if: your lot is within 100 feet of a wetland, pond, river, brook, or mapped wetland buffer. Hanover sits along the North River, Indian Head River, and Third Herring Brook corridors.

Yes if your parcel falls within 100 feet of a wetland resource area. The Hanover Conservation Commission administers wetlands review under MGL c.131 §40 (the state Wetlands Protection Act) plus Hanover's local Wetlands Protection Bylaw #6-14 (revisions effective January 17, 2007), which is stricter than the state default [Hanover Wetlands].

Adding an ADU near a wetland resource area triggers a Notice of Intent or Request for Determination filing. Even septic system repairs within the 100-foot buffer require Conservation Commission filings. Plan on adding 6 to 10 weeks to the timeline if your parcel falls within the buffer.

Cost impact: +$5,000 to $15,000, plus 6 to 10 weeks of additional review. These filings are routine for an experienced design team.

Do I need a special permit for a detached Hanover ADU? State law

Under Hanover's local bylaw, a detached ADU is permitted by special permit with Site Plan Approval from the Planning Board (§6.040.B, capped at 900 sq ft and two bedrooms, with an owner-occupancy requirement). Massachusetts state law (760 CMR 71.00, effective January 31, 2025) protects a protected-use ADU up to 900 sq ft by-right in zones that allow single-family dwellings, with no special permit [760 CMR 71]. Where the local provision conflicts with that protection, the Attorney General's published guidance treats the local provision as unenforceable.

The practical takeaway: a Hanover ADU at or under 900 sq ft should be processed as by-right rather than through a special permit. How the Building Department is administering the older special-permit language at any given moment is a question for the Building Commissioner, not something we interpret for you. Confirm the current posture at (781) 826-5000 ext. 1078 before you design to the local special-permit path.

What Does a Hanover ADU Cost?

A Hanover ADU should not be priced from square footage alone. Two 900 sq ft ADUs can price very differently depending on septic capacity, aquifer and wellhead overlays, wetland-buffer review, and site access.

BuildX ADU Pricing $284,301 to $525,861

That is the full span of our 14 floor plans. Prices include the complete building package, foundation through move-in-ready finishes. Site work is priced separately after a lot evaluation.

Hanover-specific cost premium factors

Septic upgrade (no public sewer) +$30,000 to $60,000 when an older system cannot carry the added bedroom
Aquifer / Zone II wellhead protection Adds septic design and review time near the Pond Street Wells
Wetlands buffer Conservation Commission filing +$5,000 to $15,000, plus 6 to 10 weeks of additional review
Title 5 review for older homes Required before adding a bedroom; can drive a system replacement
Site access and utility run Variable impact. Backyard access, trenching distance for water, electric, and gas, equipment staging, and utility routing can change cost meaningfully even when the ADU footprint stays the same. We map this on the Day 1 property review.

How the Hanover ADU Permit Process Works

A by-right protected-use ADU at or under 900 sq ft runs through a building permit. The septic and overlay reviews are usually what drive the timeline.

Septic comes first. In Hanover, the gating question is whether your septic system can carry an added ADU bedroom under Title 5. Resolve that before you commit to a design. The bylaw path is the easy part; the wastewater design flow is what determines feasibility on a given lot.
  1. 1

    Parcel review

    1 to 2 weeks

BuildX maps your parcel against zoning, septic capacity, FEMA flood zone, wetland buffers, and aquifer/wellhead overlay status before quoting. This is the step that determines whether the rest of the timeline is straightforward or extended. MassGIS overlay checks happen on Day 1.

  2. 2

    Title 5 and septic design

Varies by system age and condition

A Title 5 inspection and capacity check determine whether the existing system can carry the added ADU bedroom. If it cannot, septic design and a possible system upgrade come before the building permit can proceed. Near the Pond Street Wells, Zone II wellhead overlays may require additional design steps.

  3. 3

    Building permit

Confirm current turnaround with the Building Department

File the building permit through Hanover's online permit system. A protected-use ADU at or under 900 sq ft is by-right under state law. Confirm with the Building Commissioner whether the department is processing detached ADUs as by-right or still referencing the older local special-permit language at (781) 826-5000 ext. 1078.

  4. 4

    Conservation Commission filing (if triggered)

Add 6 to 10 weeks when triggered

If your parcel falls within 100 feet of a wetland resource area, a Notice of Intent or Request for Determination filing with the Hanover Conservation Commission is required under MGL c.131 §40 and the local Wetlands Protection Bylaw #6-14. These run alongside the building permit but can extend the critical path.

Overall planning assumption: the bylaw path for a 900 sq ft or smaller ADU is straightforward. The variable timeline drivers are Title 5 septic capacity and any wetland-buffer Conservation Commission filing. Resolve septic first.

After permits issue, construction inspections run through the Hanover Building Department. Confirm current administrative posture at (781) 826-5000 ext. 1078.

What Hanover Zoning Districts Allow ADUs?

Hanover's residential districts allow single-family dwellings, which is where the state by-right ADU protection applies. The town's ADU provisions sit within the Residence A District (§6.000), with attached ADUs at §6.010.J and detached ADUs at §6.040.B, on top of the underlying residential zoning. The exact dimensional schedule (minimum lot, frontage, coverage, height) is set in the Hanover Zoning Bylaw; confirm the values for your district with the Hanover Planning Department before you design.

Residential district: Residence A District (§6.000)
  • Min lot: Confirm with the Hanover Planning Department
  • Min frontage: Confirm with the Hanover Planning Department
  • Max coverage: Confirm with the Hanover Planning Department
  • Max height: Confirm with the Hanover Planning Department

ADU rules: An attached ADU is an allowed use with a building permit (§6.010.J). A detached ADU needs a local special permit with Site Plan Approval (§6.040.B), but a detached protected-use ADU up to 900 sq ft is by-right under state law (760 CMR 71.00) in zones that allow single-family dwellings.

What this means for your ADU: the zoning district rarely decides whether your Hanover ADU is feasible. Septic capacity, aquifer or wellhead overlays, and wetland buffers do. We confirm the dimensional schedule for your specific district as part of the Day 1 parcel review.

Overlay districts (aquifer, wellhead, floodplain, wetland, watershed)

Hanover's Zoning Bylaw includes a Floodplain, Wetland and Watershed Protection District, a Water Resource District, and Aquifer and Well Protection Districts. These overlays modify, but do not prevent, ADU construction. They mainly affect how septic is sited and sized, and whether a Conservation Commission filing is required.

Overlay analysis happens on Day 1 with MassGIS layers. We pull your parcel's overlays before quoting.

Multi-Family Overlay District (Hanover Crossing, Route 53)

At the December 8, 2025 Special Town Meeting, Hanover adopted a Multi-Family Overlay District at Hanover Crossing on the Route 53 commercial corridor (now codified at §6.17.0 of the Zoning Bylaw, AGO-approved April 7, 2026), bringing the town into compliance with the Massachusetts MBTA Communities Act [STM Dec 2025]. This is multi-family zoning for that corridor, not single-family ADU zoning, so it does not change the ADU rules on a residential lot. We note it here only because it signals that the town has been actively engaging with state housing law.

Source: Hanover Zoning Bylaw, Residence A District §6.000 (attached ADU §6.010.J, detached ADU §6.040.B) and the dimensional schedule (Table 7-1), as amended through the December 8, 2025 Special Town Meeting and approved by the Attorney General April 7, 2026 [Zoning Bylaw]. The bylaw repository is maintained by the Town Clerk [Town Clerk].

Sewer or Septic? Hanover Is All Septic.

This is the single biggest cost variable in any Hanover ADU project. Hanover has no public sewer for residential properties. Every Hanover ADU is a Title 5 septic project. The Hanover Water Department serves the town through its municipal well system, including the Pond Street Wells.

Public sewer (residential) None town-wide
Wastewater Private septic, Title 5
Water utility Hanover Water Department (Pond Street Wells)
Show Title 5, water utility, and wellhead details
  • Water Utility: Hanover Water Department, with DEP-approved Zone II wellhead protection over significant portions of town
  • Septic upgrade cost: $30,000 to $60,000 typical when an older system cannot carry the added bedroom
  • Title 5 trigger: Adding a bedroom adds design flow, so a Title 5 inspection is required before the ADU permit
  • Wellhead protection: Pond Street Wells fall within Zone II per the MassDEP SWAP report [MassDEP SWAP]
  • SepticSmart program: Hanover is a partner town in the NSRWA WaterSmart South Shore SepticSmart program

Hanover is all septic. We do not quote a Hanover ADU until we know whether your existing system can carry the additional ADU bedroom. A Title 5 inspection answers this question for your specific property.

Hanover by Area

Hanover covers about 15.7 square miles [Census]. Every part of town is on septic, so the area distinctions are less about sewer and more about historic character, parcel size, and where the river and pond corridors run. The areas that come up most often in ADU planning conversations:

Hanover Center Septic

Historic town center along Route 139 (Hanover Street), home to Town Hall and the government complex. Septic, like the rest of town.

Flood risk: Low.

West Hanover Septic

Western residential area, roughly 1.4 miles from the town center.

Flood risk: Low.

Assinippi Septic

Northern village near Walnut Hill, the highest point in Hanover, and a historic Wampanoag site.

Flood risk: Low.

Hanover Crossing area Septic

The Route 53 commercial corridor, site of the original Hanover Mall (1971) and now the Multi-Family Overlay District adopted at the December 8, 2025 Special Town Meeting (codified at §6.17.0). The overlay is multi-family commercial-corridor zoning, not single-family ADU zoning.

Flood risk: Low.

What Hanover's ADU Bylaw Says

Hanover's own bylaw text is the clearest statement of how the town defines and permits an ADU. The town's day-to-day operating posture on the older special-permit language is a question for the Building Commissioner.

An attached Accessory Dwelling Unit is a self-contained housing unit incorporated within a single-family dwelling, (not within accessory structures in accordance with this By-law) that is clearly a subordinate part of the single-family dwelling and complies with the criteria stated in Section 6.010.J.
Hanover Zoning Bylaw §2.100 (Definitions) Accessory Dwelling Units, definitions section Attached-ADU definition amended May 7, 2024 (submitted to the Attorney General June 2024); bylaw as amended through the December 8, 2025 Special Town Meeting, AGO-approved April 7, 2026 [Zoning Bylaw]

That is the local definition Hanover adopted. The bylaw administration sits with the Building Commissioner, reachable at (781) 826-5000 ext. 1078. State law (760 CMR 71.00) protects a protected-use ADU up to 900 sq ft by-right in single-family zones, with no special permit and no owner-occupancy requirement, which overrides Hanover's local detached special-permit and owner-occupancy provisions for a protected-use ADU [760 CMR 71].

Hanover ADU FAQs

Can I build a detached ADU in Hanover?

Yes. Hanover adopted ADU amendments within the Residence A District (§6.000) at the May 7, 2024 ATM (Attorney General approved June 2024) and refined the detached-ADU provision (§6.040.B) to a 900 sq ft size limit at the May 5-6, 2025 ATM. Locally, a detached ADU needs a special permit with Site Plan Approval (§6.040.B); under state law (760 CMR 71.00), a protected-use ADU up to 900 sq ft is by-right in zones that allow single-family dwellings, with no special permit, which overrides that local requirement. Confirm the current detached-ADU specifics with the Building Commissioner at (781) 826-5000 ext. 1078 before you submit.

Can I build an attached ADU in Hanover?

Yes. Hanover's bylaw permits attached ADUs (a self-contained unit incorporated within the single-family dwelling) with a regular building permit. As with any Hanover ADU, the gating question is whether your septic system can carry the added bedroom under Title 5.

Do I need a special permit for a Hanover ADU?

For a protected-use ADU at or under 900 sq ft, state law (760 CMR 71.00) provides a by-right protection in zones that allow single-family dwellings, with no special permit, and the Attorney General's guidance treats a conflicting local provision as unenforceable. Under Hanover's local bylaw, a detached ADU is permitted by special permit with Site Plan Approval (§6.040.B) and both attached and detached ADUs carry an owner-occupancy requirement. The practical answer is that a 900 sq ft or smaller protected-use ADU should be by-right, but the department's current administration of the local special-permit and owner-occupancy language is a question for the Building Commissioner. Confirm before you design.

Do I need to live there?

Hanover's local bylaw does require the owner to occupy either the principal dwelling or the ADU. State law bars an owner-occupancy mandate for a protected-use ADU, so that local requirement is unenforceable for a protected-use ADU up to 900 sq ft: you may live in the principal dwelling and rent the ADU, or live in the ADU and rent the principal dwelling, and long-term rental is allowed. Confirm how Hanover is applying this with the Building Commissioner before you rely on it.

Can I Airbnb my Hanover ADU?

Hanover's bylaw does not specifically address short-term rental of ADUs. Because the bylaw is silent, do not assume short-term rental is permitted. Confirm Hanover's current short-term-rental policy with the Building Commissioner at (781) 826-5000 ext. 1078 before you count on it. Long-term rental is allowed.

How big can a Hanover ADU be?

Up to 900 square feet under the state by-right protection (760 CMR 71.00). Hanover's local bylaw also caps an ADU at 900 sq ft and two bedrooms; the local limit was raised to 900 sq ft at the May 2025 ATM, and a detached ADU's local special-permit requirement is preempted for a protected-use ADU. Confirm how the department is applying the size threshold for your project.

Sewer or septic in Hanover?

Septic. Hanover has no public sewer for residential properties, so every Hanover ADU is a Title 5 project. This is the single biggest cost variable. An older three-bedroom septic system often will not carry an additional ADU bedroom without an upgrade, which adds $30,000 to $60,000 to the project. A Title 5 capacity check answers this for your specific parcel.

What does a Hanover ADU cost?

BuildX ADU pricing ranges from $284,301 to $525,861. That covers the complete building package, foundation through move-in-ready finishes; site work is priced separately after a lot evaluation. Hanover-specific drivers move a project within and beyond that band: a septic upgrade adds $30,000 to $60,000 when an older system cannot carry the added bedroom, a wetland-buffer Conservation Commission filing adds $5,000 to $15,000 plus 6 to 10 weeks, and aquifer or wellhead overlays near the Pond Street Wells add septic design and review time. For a property-specific quote, call (781) 627-7000.

Will I need a Conservation Commission filing?

If your parcel falls within 100 feet of a wetland, pond, river, brook, or mapped wetland buffer, yes. The Hanover Conservation Commission administers wetlands review under MGL c.131 §40 and the local Wetlands Protection Bylaw #6-14, which is stricter than the state default. Even septic repairs within the buffer require a filing. Plan on 6 to 10 weeks of additional review. These filings are routine for an experienced design team.

Who do I call about building an ADU in Hanover?

For official town process questions (permits, fees, the Building Commissioner's posture on detached ADUs, online permitting, building code interpretation), call the Hanover Building Department at (781) 826-5000 ext. 1078.

For parcel-level feasibility, septic capacity, cost estimates, design options, and construction planning, call BuildX at (781) 627-7000. Our office is right here in Hanover.

The two are different conversations. The town can tell you what is administratively required. BuildX can tell you what is realistic on your specific parcel and what it will actually cost to build.
