  • Size: Up to 900 sq ft is by-right (the state-law floor). 900 to 1,200 sq ft requires a Special Permit. [Section 230-8.14]
  • Districts: Allowed as-of-right in Residence A through E, plus General Business and Marine Business. [Section 230-8.14]
  • Forms: Form A (within a one-family dwelling) and Form B (within an accessory building on the same lot). [Section 230-8.14]

The state-law floor is firm regardless of the draft. Under 760 CMR 71.00 [760 CMR 71], a protected-use ADU of 900 sq ft or less, on a lot in a zone that allows single-family dwellings, is by-right and not subject to a local owner-occupancy requirement. That protection applies today. The 900 to 1,200 sq ft range that Marion's draft proposes is NOT a protected-use ADU, so the town can attach local conditions (including a Special Permit and potentially owner-occupancy or short-term-rental conditions) to that larger range.

What is still being confirmed. The final adopted text of Section 230-8.14, its Attorney General approval status, and the treatment of short-term rentals are not yet verified. Marion officials discussed tying short-term-rental permission to owner-occupancy as a possible local condition, which their staff described as potentially workable subject to legal review [Sippican Week]. Whether that survives into the adopted bylaw is a Planning Department question. Can I build an ADU in Marion right now?

Yes. A protected-use ADU of 900 sq ft or less is allowed by-right today under Massachusetts state law (760 CMR 71.00, effective January 31, 2025) in zones that permit single-family dwellings, subject to the building code and septic capacity. Marion is separately drafting a local bylaw, Section 230-8.14, that would allow ADUs up to 1,200 sq ft. Confirm the adopted status of that draft with the Building Department before planning to the larger size.

How big can a Marion ADU be?

Up to 900 sq ft is by-right under state law (or 50% of the principal dwelling, whichever is smaller, for a protected-use ADU). Marion's draft Section 230-8.14 proposes allowing ADUs up to 1,200 sq ft, with a Special Permit required for the 900 to 1,200 sq ft range. Sewer or septic in Marion?

Depends on your parcel. Marion has substantial public sewer in Marion Village (the central village), while outlying areas rely on private septic. This is one of the biggest cost variables. A Title 5 capacity check plus possible system replacement adds $30,000 to $60,000 to a septic-served Marion ADU project. In sewered areas, the draft Section 230-8.14 requires connection to public sewer, subject to DPW capacity review. Confirm sewer availability by your specific address.

What about Buzzards Bay water quality?
