Norwell adopted its Protected ADU bylaw (§201-8.1E) at the May 5, 2025 Annual Town Meeting, Article 43 [Bylaw §201-8.1E]. Norwell's District Use Regulations have been amended many times over the years, but the by-right protected-ADU framework dates to this 2025 amendment, which brought the bylaw into line with state housing law. Under §201-8.1E, a maximum of one protected ADU is allowed per lot, interior and detached ADUs are both permitted, and the unit is allowed as-of-right with no special permit, variance, or waiver. The size cap is 900 sq ft or 50% of the principal dwelling, whichever is smaller.

Can I build an ADU in Norwell, MA?

Yes. Norwell allows interior and detached ADUs by-right under Zoning Bylaw §201-8, up to 900 sq ft or 50% of the principal dwelling, whichever is smaller. Interior ADUs need only a building permit. Norwell already rewrote its ADU bylaw to match state law. Norwell adopted a Protected ADU bylaw (§201-8.1E) at its May 5, 2025 Annual Town Meeting [Bylaw §201-8.1E], drafted to comply with Massachusetts state law (760 CMR 71.00, effective February 2, 2025) [760 CMR 71]. For a protected ADU, the bylaw already drops the limits the older ADU rules carried:

  • No bedroom limit: A protected ADU has no bedroom cap. The old one-bedroom limit now applies only to non-protected ADUs.
  • No owner-occupancy requirement: You are not required to live in either unit for a protected ADU. Owner-occupancy now applies only to non-protected ADUs.
  • One-acre lot minimum cannot block you: State law prevents Norwell from using its general one-acre lot minimum to deny a protected ADU.

Can I build a detached ADU in Norwell?

Yes, by-right, with one extra step. Norwell's §201-8 allows detached ADUs as-of-right, up to 900 sq ft or 50% of the principal dwelling. A detached ADU is also by-right, provided it meets the district's setback, frontage, and height standards. Only a dimensionally nonconforming detached unit needs Zoning Board of Appeals relief. Interior ADUs never face this step.

Is an interior ADU easier to permit in Norwell?

Yes. An interior ADU inside the existing single-family dwelling is pure by-right in Norwell: a building permit only, with no extra zoning hearing. It still has to meet the size cap, the parking and entrance-visibility rules, and the Title 5 and reserve-area requirement, and the short-term-rental covenant still applies. But the permit path is shorter than a detached ADU.

Do I need a special permit for a Norwell ADU?

No. Norwell's §201-8 allows ADUs as-of-right, with no special permit, variance, or waiver. Interior ADUs need only a building permit. A detached ADU is also by-right; it only needs Zoning Board of Appeals relief if it would be dimensionally nonconforming.

Do I have to live there?

Norwell's Protected ADU bylaw (§201-8.1E) has no owner-occupancy requirement, so you are not required to occupy either unit. (Owner-occupancy applies only to non-protected ADUs that go through the special-permit route.) Confirm your situation with the Building Department at (781) 659-8018 before signing a lease.

Can I build a two-bedroom ADU in Norwell?

Norwell's Protected ADU bylaw (§201-8.1E) sets no bedroom limit for a protected ADU, so a two-bedroom ADU is fine. (The old one-bedroom limit applies only to non-protected ADUs.) Any unit still has to fit within the 900 sq ft or 50% size cap, and on a septic town the bedroom count drives wastewater design flow, which affects the Title 5 and septic design. Can I Airbnb my Norwell ADU?

No. Norwell requires a recorded restrictive covenant on the property deed prohibiting short-term rental use. This is a permanent encumbrance that records at the Plymouth County Registry of Deeds and survives a sale. If your business model is Airbnb or VRBO, Norwell is not your town. Long-term rental is allowed.

How big can a Norwell ADU be?

Up to 900 square feet, or up to 50% of the principal home's floor area, whichever is smaller. This matches the state by-right cap under 760 CMR 71.00, so Norwell's size rule and state law align.

Sewer or septic in Norwell?

Septic, town-wide. Norwell has no public sewer system, so every residential parcel is on private septic. Adding an ADU adds wastewater design flow, so a Title 5 review applies on every project, and §201-8.1E lets the Board of Health apply standards stricter than Title 5. This is the single biggest cost variable. A Title 5 capacity check plus possible system replacement adds $30,000 to $60,000 to a Norwell ADU project.

What does a Norwell ADU cost?

Can I build an ADU on septic in Norwell?

You will have to, because Norwell has no public sewer. Every Norwell ADU is a septic project. The existing system must have capacity under Title 5 (310 CMR 15.000) to handle the additional design flow an ADU adds, and §201-8 requires the Board of Health to document a reserve area as well.

If your existing system lacks capacity, an upgrade or full replacement adds $30,000 to $60,000 or more to the project cost.
