Carver adopted Article 23, Changes to Accessory Apartments, at the 2025 Annual Town Meeting, and published the amended ADU bylaw on March 11, 2025 [Article 23]. The amendment aligned Carver's local rules with Massachusetts state law (760 CMR 71.00, effective January 31, 2025) [760 CMR 71]. It is one of the most comprehensively cleaned-up ADU bylaws we have seen on the South Shore: Article 23 amended four sections of the zoning bylaw at once (§290-2-2.6 Accessory Apartments, §290-2-2.3 Use Regulation Schedule, §290-6.2 Terms, and §290-3-3.3 Table of Parking Requirements) [Article 23]. Detached, attached, and interior-conversion ADUs are allowed by-right wherever a single-family home is allowed, up to 900 sq ft or 50% of the principal dwelling, whichever is smaller.

Carver's ADU rules live in §290-2-2.6 (Accessory Apartments), with companion changes in §290-2-2.3 (Use Regulation Schedule), §290-6.2 (Terms), and §290-3-3.3 (Table of Parking Requirements). All four were amended by Article 23 at the 2025 Annual Town Meeting [Article 23]. The amended bylaw text reads:

"Wherever a single family home is allowed an ADU is also allowed. In addition, the Planning Board added the Village Business Zoning District for ADUs." Carver Zoning Bylaw, Article 23 Changes to Accessory Apartments, amended ADU bylaw published March 11, 2025.

Village Business district. In addition to every district that allows single-family homes, Carver added the Village Business Zoning District for ADUs [Article 23]. That is broader than typical and can matter for mixed-use properties along Route 58. If your parcel is in the Village Business district, confirm with the Carver Planning Department at (508) 866-3450 how the bylaw applies to your specific lot.

The bylaw recognizes state preemption directly. Carver's amended bylaw text explicitly identifies the protections that state law (760 CMR 71.00) places beyond local regulation for protected-use ADUs: density calculations, architectural restrictions stricter than the state building code, short-term-rental restrictions inconsistent with state law, owner-occupancy of the principal dwelling, minimum parking beyond the state caps, use and occupancy restrictions, and unit caps [Article 23]. The bylaw states that protected-use ADUs are not counted in any density calculations [Article 23].

Pre-amendment language that state law preempts. Carver's older bylaw limited accessory apartments to "elderly (as defined by 55 years of age and older) and/or handicapped persons" and made a permit "good for three (3) years." For protected-use ADUs, state law does not restrict the occupant by age or disability, and a protected-use ADU permit does not expire that way [760 CMR 71]. Article 23 brought the bylaw in line with that [Article 23]. Confirm Carver's current administrative posture with the Building Department at (508) 866-3405 before you design around either provision.

Historic district review is separate. If your parcel is in a Carver Historic District Commission designated area, a Certificate of Appropriateness is required for the ADU [Article 23]. That is a design review, not a special permit on the ADU itself, but it adds a step. We coordinate it.

For most Carver homeowners, the practical answer is straightforward. A Carver ADU at or under 900 sq ft, on a single-family lot, is a by-right project that runs as a building permit through the Carver Building Department. The state framework behind this is the Affordable Homes Act, which amended MGL Chapter 40A to make protected-use ADUs by-right [MGL 40A]. Where Carver ADU projects actually slow down is upstream of zoning: Title 5 capacity on septic-served lots (most of Carver), the Plymouth-Carver Aquifer wellhead-protection overlay, and Conservation Commission filings near the town's many cranberry bogs, ponds, and streams.

Garage conversion ADU

A common variation of either the detached or attached ADU paths, depending on the garage configuration. Carver's bylaw does not treat garage conversion as a separate ADU category; it is classified based on whether the converted structure is structurally attached to the principal dwelling.

  • If the garage is detached from the house: Treated as a detached ADU (New Construction permit or major alteration)

The Plymouth-Carver Aquifer is the single most important regional consideration for a Carver ADU. It is the regional drinking-water resource the town is named for, and multiple aquifer and wellhead protection overlays apply across town, with particular sensitivity given Carver's cranberry-bog water use and residential development [MassGIS]. If your parcel is in a Carver Historic District Commission designated area, the ADU requires a Certificate of Appropriateness from the Commission [Article 23]. That is a design review of massing, materials, and appearance, separate from the building permit. It is not a denial mechanism, but it adds a step and some time on the affected parcels.

Carver's Building Department has Tuesday extended evening hours to 7:00 PM, which helps working homeowners who cannot get to Town Hall during the day [Building Dept]. We handle the paper process and the in-person Town Hall visits as part of the build.

Does transit affect Carver ADU parking? No MBTA

Likely affects you if: you were counting on a transit-adjacent parking exemption. Carver has no MBTA station, so most parcels will not qualify.

Carver does not have its own MBTA station. The closest is Middleborough/Lakeville, reached via I-495 [760 CMR 71]. State law's transit-adjacent parking exemption keys off a 0.5-mile radius of a station, so most Carver properties are unlikely to qualify [760 CMR 71].

Carver's larger rural lots usually make on-site parking straightforward to lay out regardless, so this rarely drives ADU design here the way it can in a transit town.

Sewer or Septic? Carver Is Mostly Septic.

This is the single biggest cost variable in a Carver ADU project. Carver is largely on private septic with only limited municipal sewer. On top of that, much of the town sits over the Plymouth-Carver Aquifer, so septic review carries an extra layer of care. Confirm sewer availability for your specific parcel before you design.

On paper. Carver does not offer online permitting at this time. You print the building permit application, complete it, and bring it to the Building Department at Town Hall, 108 Main Street. The Building Department has Tuesday extended evening hours to 7:00 PM, which helps if you work days. We handle the paper process and the in-person visits as part of the build.

What about the Plymouth-Carver Aquifer?

It is a real consideration. The Plymouth-Carver Aquifer is the regional drinking-water resource the town is named for, and Zone II wellhead protection overlays apply across much of Carver.
