Can I build an ADU in Wareham, MA?

Yes. Can I build a detached ADU in Wareham?

Yes, by-right. A protected-use ADU, detached, attached, or interior, is permitted by-right under Massachusetts state law (760 CMR 71.00) in zones that allow single-family dwellings, up to 900 sq ft or 50% of the principal dwelling, whichever is smaller. Does Wareham have an ADU bylaw?

Yes. Wareham adopted a local ADU bylaw at its April 28, 2025 Special Town Meeting (Article S15), creating Zoning Bylaw Section 860. Do I need a special permit for a Wareham ADU?

No, not for a single protected-use ADU. Under state law (760 CMR 71.00) and Wareham's adopted bylaw, one protected-use ADU per lot is by-right and does not require a special permit.
